Forms, Permits, Guidelines, and Fact Sheets Used by Hamiltonban Township

Start by reading this summary to see when a zoning or building permit is required. Next, contact Pennsylvania Municipal Code Alliance (PMCA 717-496-4996) with a description of your project to learn whether a Uniform Construction Building Permit is required. You may start the permitting process by calling the Township Zoning Officer at 717-496-4996, ask for the Hamiltonban Zoning Officer. The duties of the Zoning Officer are defined in Section 2211 of Article XXII of the Zoning Ordinance. The Zoning Officer will provide you with the necessary application forms, procedures, information, and the "order of events" that is necessary to obtain the required permit(s) for the activity you are considering. Construction within a floodplain or within fifty feet (50') of a stream bank - contact the Adams County Conservation District at 717-334-0636. Any construction within a floodplain or questionable floodplain or within fifty feet (50') of a stream bank must be approved before any form of permitting is started. It is the responsibility of the landowner to have the floodplain boundary established to the satisfaction of the zoning officer.
A legally deeded parcel of property in the name of the person(s) requesting construction/building/renovation/demolition must exist before the permitting process can be started. In the case of rental property, a letter from the property owner approving the construction/building/renovation must be presented to the Township Zoning Officer before the permitting process can start.

Application for a Zoning/Land Use Permit
A Land Use/Zoning Permit is required before starting construction, reconstruction, enlargement, alteration, modification, demolition, or relocation of a building or structure in the Township. To apply for a Land Use/Zoning Permit, fill out this form and submit it to the Township Zoning Officer for his review and approval.
Supplement to Land Use Zoning Permit
Under certain conditions, additional information must be submitted to supplement the information contained on the Land Use/Zoning Permit. This form is used to submit such information.
Application for Plan Examination and UCC Building Permit
Before starting construction of a building within the Township, this form must be filled out and submitted to the Township's Uniform Construction Code (UCC) inspection contractor, Pennsylvania Municipal Code Alliance (717-496-4996). The UCC inspector will review the building plans and inspect the building during its construction.

.A description of ALL planned disturbance of ground is required before issuance of any related permit(s), including but not limited to building and/or demolition permits. Before applying for such a permit, fill out the Adams County Conservation District's Erosion and Sedimentation Checklist. Then, review the form with the Hamiltonban Township Zoning Officer. In many instances, an Erosion and Sedimentation Control Plan will be required. Guidelines for erosion and sedimentation control are given below.
Erosion and Sedimentation Control Guidelines
Erosion and sedimentation from stormwater runoff must be controlled whenever construction involves ground disturbance. These guidelines give an overview of the control process, and under what conditions the various plans and permits are required, and contact information for Adams County Conservation District, the reviewing and permitting agency. Additional information on the requirements for Erosion and Sedimentation Control may be found at the Adams County Conservation District's web page at the Adams County website.
Demolition Permit Factsheet and Demolition Application Form
When considering demolition of a building or structure in the Township, first read and review the information included in the Demolition Permit Factsheet. Start the permitting process by filling out the Demolition Application Form, then submitting the completed form to the Township Zoning Officer, who will provide you with the necessary procedures, information, and the "order of events" that is necessary to obtain the required permit(s) for the activity you are considering.
Application for a Well Construction Permit
This application form must be filled out and submitted to the Township Zoning Officer for his approval before beginning construction of a well in the Township. For more information on well construction requirements, see the Township's Well Ordinance, and Well Ordinance Construction Standards
Application for Sewer/Septic Permit
Before starting construction of a sewer hookup or a septic field/sand mound within the Township, the appropriate permit may be required. The requirements for such a permit may be obtained from the Township Sewage Enforcement Officer (SEO), Gilbert Picarelli, of KPI Technology, Inc. (717-339-0612) The SEO will review the septic system plans and inspect the septic system during and after its construction. When applicable, this permit must be obtained before any other construction or building permit will be issued.
Certificate of Occupancy
A Certificate of Occupancy must be obtained from the Township Zoning Officer before you may use or occupancy of a new structure. Final inspection(s) will be conducted by the UCC inspector, or if the UCC does not apply, by the Township Zoning Officer. After the final inspection(s), a Certificate of Occupancy will be issued, providing the inspections have not revealed any deficiencies in the structure, well, or septic system, if applicable.
Application for a Driveway Permit
This application form must be filled out and submitted to the Township Roadmaster (717-642-8531) for his approval before beginning construction of a driveway on a Township-maintained Road. When applicable, this permit must be obtained before any other construction/building permit(s) can be issued and will be issued only after consultation with and approval of the Township Roadmaster.
Application for a Road Occupancy Permit
Construction of a driveway on a State-maintained Road within the Township requires a PennDOT permit. An application form for a PennDOT Highway Occupancy Permit may be obtained from Pennsylvania Department of Transportation, Highway Occupancy Permits, Rm 12: 2140 Herr St., Harrisburg, PA 17103-1699. Carrolls Tract Rd, Fairfield Rd (Rt 116), Fairfield Station Rd, Iron Springs Rd, Jacks Mountain Rd, Orrtanna Rd, Tract Rd, Water Street, Waynesboro Pike are all State-maintained roads.
Application to Conduct a Customary Home Occupation
Approval by the Hamiltonban Board of Supervisors is required before you may conduct a business out of a home. See Section 1801.Z. Home Occupations of Article XVIII of the Township Zoning Ordinance. To apply to conduct a customary home occupation, complete this form and submit it to the Township Zoning Officer.
Application for a Conditional Use Permit
Certain activities are neither allowed nor prohibited by the Township Zoning Ordinance but may be permitted as a conditional use in various zones. See Article XXI, Non-Conforming Uses of the Township Zoning Ordinance. To apply for a Conditional Use Permit, complete this form and submit it to the Township Zoning Officer.
Application to Appear Before the Zoning Hearing Board
The Township has established a Zoning Hearing Board (ZHB) in accordance with Article XXII, "Enforcement and Administration," of the Township Zoning Ordinance. The ZHB may hold hearings and adjudicate challenges to the Zoning Ordinance or zoning decisions by the Township Zoning Officer or the Board of Supervisors. Application for a Sign Permit
A permit is required before posting certain signs within the Township. The Township sign regulations are defined in "Sign Regulations" of Article XX of the Township Zoning Ordinance. To apply for a Sign Permit, complete this form and submit it to the Township Zoning Officer.
Right-to-Know Requests
The Commonwealth of Pennsylvania requires that all municipal agencies establish regulations and policies to implement the state's Right-to-Know law. Hamiltonban Township, by Resolution 2020-07, established an Open Records Policy whereby it will make available to the public for inspection, retrieval, and duplication, all Township documents deemed public records. To implement the state Right-to-Know law, the Hamiltonban Board of Supervisors has appointed the Township Secretary as the Hamiltonban Open Records Officer. The state has also established the Pennsylvania Office of Open Records to enforce the state’s Right-to-Know law and to serve as a resource for citizens, public officials and members of the media in obtaining public records of their government. If a request for a record or portion of a record is denied, the requestor may file an appeal with the Office of Open Records.
